SCNX Shared Marketplace Content - Terms of Service
These terms apply to an upcoming feature that might not be available for your account yet. You will be prompted to agree to these terms when trying to enable a feature that requires agreement (such as the SHARED_CONTENT feature flag).
Until you agree, these terms do not apply to you. Agreement is not required to use SCNX.
Furthermore, content shared
via the private "Share message" or "Share custom command" buttons is not subject to these terms unless listed to the
marketplace or until you agree to these terms.

Welcome to the SCNX Shared Marketplace Content system (the "Marketplace"). SCNX is a product of ScootKit UG (haftungsbeschränkt), registered in the Munich Commercial Register under HRB 296162 (hereinafter referred to as "ScootKit", "SCNX", "we", "us", or "our").
This document represents a legally binding agreement between you—whether acting as an individual creator, a server owner, or a marketplace organization (hereinafter "you", "your", or "Submitting Owner")—and ScootKit UG (haftungsbeschränkt).
By enabling the SHARED_CONTENT feature flag, accessing our Marketplace APIs, explicitly agreeing to these terms when prompted, or submitting any content via our web interfaces, you explicitly agree to these Terms. These Terms are supplemental to the general SCNX Terms of Service ("Nutzungsbedingungen"). They are specifically designed to foster a safe, reliable, and high-quality environment for sharing bot configurations. In the event of a direct conflict regarding marketplace content between the general terms and these specific rules, these Marketplace Terms shall prevail.
1. Definitions and Scope of Services
The Marketplace allows users to create, share, distribute, and potentially monetize pre-configured assets for Discord bots hosted on the SCNX platform. This ecosystem relies on mutual trust and high-quality contributions.
To ensure absolute clarity regarding your rights, responsibilities, and the technical mechanics of the platform, the following capitalized terms hold specific meanings throughout this document:
- "SCNX Dashboard" refers to the official web-based control panel (typically located at scnx.app) where users configure their bots, manage their accounts, and access platform features like the Private Sharing System.
- "Shared Content" refers to any data, file, or configuration submitted to the Marketplace ecosystem, regardless of its specific format or intended function. Note that there are also ways to share content outside of the marketplace ( e.g., private sharing buttons). Once you agree to these Terms, they also fully apply to any content shared via those external or private methods.
- "Messages" refers to visual layouts utilizing the SCNX V3 or V4 JSON message schemas. This includes complex embed structures, text displays, interactive action rows (like buttons and dropdown menus), and media galleries designed to be displayed within Discord channels.
- "Configuration Templates" refers to pre-configured module settings designed to be applied directly to a user's bot module config fields. Examples include comprehensive Auto-Moderator rulesets, pre-built Welcome Module greetings, or complex Ticket System category setups.
- "Custom Commands" refers to exported or shared command structures, logical workflows, variable configurations, and automated actions created within the SCNX ecosystem. This encompasses everything from simple text-response slash commands to highly complex interactive workflows involving multiple steps and conditional logic.
- "Key" or "Import Key" refers to the unique, system-generated alphanumeric string or URL parameter used to securely access, share, and import a specific piece of Shared Content into an end-user's configuration.
- "Submitting Owner" refers to the individual human being or the registered marketplace organization that creates, authors, and ultimately uploads Shared Content to the Marketplace for public or private distribution.
- "API Token" or "Marketplace API Token" refers to the secret authentication string generated by SCNX that allows your programmatic applications or scripts to securely authenticate and interact with the Marketplace APIs.
- "Metadata" refers to all supplementary information, visual assets, and classification data provided alongside Shared Content, including but not limited to titles, descriptions, tags, category assignments, thumbnails, version numbers, and dependency lists.
- "SHARED_CONTENT Feature Flag" refers to the specific account permission or toggle within the SCNX Dashboard that grants a user or organization the technical authorization to submit, manage, and distribute Shared Content on the Marketplace.
- "End-User" or "Importer" refers to the individual or server administrator who utilizes an import key or public marketplace listing to add Shared Content to their own SCNX-hosted bot.
- "Private Sharing System" refers to features within the SCNX Dashboard (such as the "Share message" or "Share custom command" buttons) that generate unlisted, private import keys. These keys are designed for direct, one-on-one sharing rather than public aggregation.
- "External Web Directories" or "Public Listing Pages" refers to any website, forum, database, third-party platform, or digital storefront outside of the official SCNX domain that is used to publicly aggregate, advertise, or distribute SCNX import keys to a general audience.
- "Personal or Transactional Context" refers to direct sharing between personal acquaintances (e.g., sending a key to a friend) or a direct, one-to-one transfer from a creator to a paying client securely off-platform.
2. Submitting Marketplace Owner Obligations
As a Submitting Owner, you act as a provider of content to the broader SCNX community. End-users rely on your creations to manage their own communities. Therefore, by submitting Shared Content, you legally warrant and obligate yourself to the following standards:
- Eligibility and Sanctions Compliance: You confirm that you meet the minimum age requirements specified in the general SCNX Terms of Service. Furthermore, you warrant that you do not reside in, and are not a citizen of, comprehensively sanctioned regions (including but not limited to North Korea, Cuba, Russia, Syria, Sudan, Iran, the Crimea region, Donetsk, and Luhansk), and are not listed on any national or international state sanctions list.
- Originality and Ownership: You guarantee that you are the sole original creator of the Shared Content, or that you have secured all necessary legal rights, explicit licenses, and permissions from third parties to distribute the content on our platform.
- Quality, Functionality, and Pre-Publication Testing: You are strictly required to thoroughly test your Configuration Templates, Messages, and Custom Commands in a live server environment before publication to the Marketplace. You must ensure they function safely, are free of critical logic errors, are completely compatible with current SCNX systems, and perform exactly as described in your marketplace listing.
- Accurate Representation: The display name, description, and visual previews of your Shared Content must accurately and honestly reflect the actual imported content. Misleading descriptions, exaggerated claims of functionality, or "bait-and-switch" tactics designed to artificially inflate your import numbers are strictly prohibited.
- Documentation Requirements: You must provide clear, accurate, and comprehensive documentation for your Shared Content in the provided description fields. For complex Configurations or Custom Commands, your documentation must clearly explain what the content does, detail any external APIs or services it contacts, and outline any necessary manual setup steps required by the end-user (such as setting up required text variables, configuring external API keys, or adjusting role hierarchies).
- Customer Support: You must provide reasonable, timely, and helpful customer support to users who import or purchase your Shared Content. You are required to maintain up-to-date customer service links (such as a dedicated support Discord server or a actively monitored support email address) on your marketplace organization profile and within your content listings. Ignoring legitimate support requests may result in the demotion or removal of your content.
- API and Account Security: You are solely responsible for maintaining the strict confidentiality and security of your Marketplace API tokens, private import keys, and SCNX account credentials. SCNX is not liable for any unauthorized modifications, deletions, or malicious distributions of your content resulting from compromised credentials or poor security practices on your end.
- Maintenance: The SCNX platform and the underlying Discord API are constantly evolving. If these underlying systems update and render your Shared Content broken, buggy, or obsolete, you are heavily encouraged to update the content to restore functionality or clearly mark it as a legacy item. SCNX reserves the right to unlist or delete perpetually broken content to protect the end-user experience.
- Updates and Changelogs: When releasing updates to your existing Shared Content, you are strictly required to maintain a clear, accurate, and up-to-date changelog. This changelog must detail all modifications, bug fixes, altered logic, or new features included in the update to ensure end-users are fully informed before applying the new version to their live servers.
- Metadata and Discovery Standards: To maintain a high level of professional quality comparable to other leading digital asset marketplaces, you must provide comprehensive and accurate Metadata for every submission.
3. Strict Limitations on Shared Content
To ensure the security, privacy, and functional integrity of the entire SCNX ecosystem, all Shared Content is subject to the following absolute limitations. Violating these limitations will result in severe penalties, including immediate account termination (see Section 7).
3.1. The Discord API Restriction
You are strictly prohibited from submitting, uploading, publishing, or sharing any data, messages, objects, or content that was scraped, bulk-fetched, reverse-engineered, or otherwise obtained directly from the Discord API. This rule exists to comply strictly with Discord's Developer Terms.
- Only content originally, manually generated and structured directly within the SCNX API ( /marketplace-api/shared-content) or authored through the official SCNX frontend web interface qualifies for sharing on the Marketplace.
3.2. Prohibition of Personal Information (PI)
You must not include any Personal Information (PI) or Personally Identifiable Information (PII) within the code or text of your Shared Content. This includes, but is not limited to: real names, physical addresses, phone numbers, email addresses, private Discord user IDs, IP addresses, or any data that could reasonably identify a specific human being.
Furthermore, you are strictly prohibited from submitting content (such as Custom Commands, interactive message components, or application forms) that is explicitly designed to solicit, obtain, collect, or store PI or PII from end-users under false pretenses. Forms asking for sensitive real-world data are not permitted on the Marketplace.
3.3. Guild-Specific Identifiers
Shared Content must be universally applicable across different Discord servers. You must not include server-specific IDs in your public templates, as these will inherently break when imported into a new environment.
- Prohibited: Hardcoded Discord role IDs, specific channel IDs, specific user IDs, or guild-specific custom command click IDs.
- Allowed: Generalized components (e.g., standard external link buttons) or dynamic placeholder variables provided natively by the SCNX schema (e.g., utilizing %username% or %server_name% to automatically adapt to the importer's server).
3.4. Custom Command Safety Restrictions
Custom Commands submitted to the Marketplace contain executable logic and have the potential to impact bot performance globally. Therefore, they must adhere to strict safety guidelines:
- No Malicious Logic: Commands must not contain logic designed to exploit the bot, crash the SCNX infrastructure, create infinite recursive loops, or intentionally bypass Discord's rate limits.
- External API Calls: If your Custom Command interacts with external third-party APIs via HTTP requests, these APIs must be safe, legally compliant, and publicly documented. You may not call APIs that execute malicious code, APIs that scrape Discord, or APIs designed to secretly exfiltrate user data. Any and all external API calls must be clearly disclosed and explained in your content's description so users know where their server's requests are going.
- Data Transmission Restriction: Crucially, any data, messages, user details, server information, or other content legitimately obtained by the SCNX bot via the Discord API may not be transmitted, shared, sent to, or stored on external APIs or third-party servers under any scenario. Your commands must respect the privacy boundaries of the SCNX ecosystem.
- No Premium Bypasses: You may not share Custom Commands explicitly designed to grant free access to features, resources, or modules that SCNX normally restricts to premium or paid tiers.
- No Spam: Commands must not be designed to facilitate automated mass-messaging (spamming), unauthorized bulk direct messaging (DMing) of users, or automated server raiding tactics.
3.5. Image and Media Usage Requirements
When sharing content that contains images (e.g., Message embeds, custom thumbnails, or image galleries), you must adhere to the following rules to ensure long-term availability, prevent tracking pixels, and maintain legal compliance:
- Required Hosting: All images used in Shared Content must be uploaded to and hosted exclusively on * scnx-cdn.scootkit.net* or other official SCNX APIs. Hotlinking to external domains (including Imgur, Discord's internal CDN, or personal web servers) is strictly prohibited for shared marketplace assets to prevent dead links and external IP logging.
- Ownership: You must own the intellectual property rights to the images you upload, or hold a valid, verifiable license that permits their free use and commercial distribution in this manner.
- Storage Requirements: Images uploaded for marketplace use are subject to SCNX's overall storage requirements, file size limits, and technical processing guidelines.
- Non-Deletion: Once an image is tied to published Shared Content on the marketplace, the image may not be deleted or removed by you. Deleting an image would permanently break the visual content for all users who have already imported it. By uploading the image for marketplace use, you explicitly agree that SCNX will retain the image indefinitely on our CDN to support the imported configurations.
3.6. General Content Restrictions
Your content must comply with all Discord Community Guidelines and the SCNX general Terms of Service. You may not share content that is sexually explicit (NSFW), highly offensive, defamatory, illegal under the laws of the Federal Republic of Germany, promotes violence or self-harm, or infringes on third-party intellectual property (such as using copyrighted video game assets, brand logos, or trademarked characters in your embeds without explicit legal permission).
3.7. Rules for External Public Distribution and Documentation Parity
If you utilize the SCNX private sharing system (e.g., generating private, unlisted import keys via the "Share message" or "Share custom command" features) for your Shared Content, you may distribute those keys within a personal, private, or directly transactional context.
You are permitted to distribute, publish, or aggregate your Shared Content on public, third-party listing pages, external web directories, or other platforms only if that exact content is also officially listed and available on the SCNX Marketplace. To ensure the SCNX Marketplace remains a high-quality and comprehensive resource for our users, you are strictly required to set and submit all available optional marketplace fields (including detailed descriptions, setup guides, and optional metadata) if you have submitted similar or more detailed data to any other third-party pages or external directories. You must not provide a "minimalist" listing on SCNX while offering full documentation elsewhere. Any significant documentation gap between your SCNX listing and external mirrors is considered a violation of these terms.
You may not use the SCNX sharing system as a backend to supply external public directories without also contributing to the SCNX Marketplace ecosystem.
Please note that once you have agreed to these Terms, they apply fully to any content you share via our tools, even if distributed outside of our official marketplace.
3.8. Marketplace API Usage Restrictions
The Marketplace API and the API Tokens provided to you are privileged tools intended exclusively for managing, updating, and distributing your own digital creations. Access to these programmatic endpoints is a revocable privilege. When utilizing your API Token or connecting to any SCNX APIs, you must abide by the following comprehensive and strict rules:
- No Source Code Exposure (Strict Prohibition): You are strictly prohibited from utilizing the API, custom commands, or any platform feature in a manner that exposes, leaks, or distributes the underlying backend source code, proprietary algorithms, database structures, or internal system configurations of SCNX to end-users or any third parties under any circumstances.
- Restricted Access to Own Content: You may only use the API to legitimately access, create, format, or update your own Shared Content. Attempting to manipulate API endpoints to access, modify, overwrite, or delete content belonging to other Submitting Owners or the SCNX platform itself constitutes a severe security violation.
- No Scraping, Harvesting, or Bulk-Downloading: You are strictly prohibited from using our APIs to scrape, bulk-download, clone, or harvest content, user data, configuration templates, or marketplace listings that belong to other creators or SCNX. Automated enumeration of our database or API endpoints is explicitly banned.
- No Competitor Migration or Extraction: You may not use the API or the Marketplace infrastructure to build services, automated tools, or extraction scripts designed to migrate SCNX configurations, commands, or templates to competitor platforms or personal, self-hosted Discord bots outside the SCNX ecosystem.
- Rate Limiting and Abuse Prevention: You must respect all documented and programmatic rate limits applied to the SCNX APIs (e.g., 20 requests per 10 minutes for Shared Content). Intentionally spamming requests, attempting to DDoS our infrastructure, or employing technical measures to bypass IP blocks and rate limits (such as rotating proxy networks or distributed botnets) will result in immediate API Token revocation and platform bans.
- Prohibition of Payload Manipulation: You may only submit API payloads that strictly conform to the official SCNX V3 or V4 JSON message schemas and approved configuration structures. Submitting malformed data, attempting to execute cross-site scripting (XSS), performing SQL/NoSQL injections, or sending payloads designed to exploit vulnerabilities in the SCNX message parser is forbidden.
- Non-Transferability of API Tokens: Your Marketplace API Token is securely tied to your specific organization or user account. You may not sell, trade, lease, or publicly expose your API Token. If you suspect your API Token has been compromised or leaked, you are legally obligated to regenerate or revoke it immediately via the SCNX Dashboard to prevent unauthorized distribution.
- Use of Approved Endpoints Only: You must only interact with the officially documented SCNX Marketplace API endpoints. Attempting to discover, probe, or access internal, undocumented, or administrative SCNX endpoints is a direct breach of platform security.
4. Intellectual Property, Broad Licensing, and AI Training
By submitting Shared Content to the Marketplace, you retain the underlying moral rights and original ownership to your specific creation. However, to operate a global platform, you must grant SCNX the comprehensive legal rights necessary to operate, distribute, and leverage the platform effectively.
4.1. Comprehensive License Grant
You hereby grant ScootKit UG (haftungsbeschränkt) an irrevocable, perpetual, non-exclusive, fully transferable, worldwide, royalty-free, and fully sublicensable right and license to:
- Use, host, store, reproduce, modify, adapt, publish, translate, and securely distribute your Shared Content across our network.
- Create derivative works from your Shared Content (for example, generating localized versions or optimizing the schema format for future V5 updates).
- Display and perform your Shared Content publicly across any media format or channel now known or later developed, including featuring your content in SCNX promotional materials.
4.2. Commercialization and Distribution Rights
You expressly authorize SCNX to distribute your Shared Content to other users via our automated import systems (e.g., via public discovery or private keys). Furthermore, you grant SCNX the right to commercialize, package, and sell the content you submit to other users or third parties for our own business purposes, without any obligation to provide financial compensation, revenue shares, or royalties to you, unless a separate, explicit monetization contract is signed directly with us.
4.3. Explicit Consent for Artificial Intelligence (AI) Training
You acknowledge and explicitly agree that SCNX may utilize any and all Shared Content you submit (including but not limited to message schemas, configuration files, text content, formatting choices, and custom command logic) for analytical and developmental purposes. This strictly includes the right to use your data as training data to develop, train, fine-tune, or improve artificial intelligence (AI) models, machine learning algorithms, natural language processing systems, or similar advanced technologies, whether utilized internally to SCNX or developed in partnership with third parties to improve platform features (such as AI-assisted command generation).
4.4. Third-Party Assets and Prohibition of Viral Licenses
- Third-Party Assets: You must explicitly disclose in your content's documentation if your Shared Content relies on any third-party open-source components, snippets, or libraries. You are solely responsible for ensuring that any included third-party components are fully legally compatible with the broad license grant provided to SCNX in Section 4.1.
- Prohibition of Viral Licenses: You are strictly prohibited from submitting any content that is subject to " copyleft" or viral licenses (such as the GNU GPL or AGPL) if those licenses would compel SCNX to disclose its proprietary backend source code, distribute our own derivative works under the same viral license, or force us to offer our paid hosting services for free.
5. Marketplace Distribution, Surfacing, and Monetization
5.1. Content Surfacing and Algorithmic Display
SCNX utilizes proprietary algorithms, performance metrics (like import success rates), automated evaluations, user engagement signals, and editorial discretion to determine how, when, and where Shared Content is "surfaced" (i.e., displayed, ranked, recommended on the front page, or categorised) within the Marketplace interface.
- No Guarantee of Visibility: We do not guarantee any specific placement, search ranking, visibility, or promotional surfacing for your submitted content.
- Right to Deny: SCNX reserves the absolute right to deny, unlist, demote, hide, or completely refuse to surface any Shared Content at any time, for any reason, without prior notice or justification to the Submitting Owner.
5.2. Analytics and Performance Tracking
SCNX may track, estimate, and display metrics related to your Shared Content on your creator dashboard, including but not limited to views, unique imports, successful implementations, and usage counts. You acknowledge that these metrics are provided for informational and internal guidance purposes only. They are not legally binding, may rely on educated guesses, approximations, or automated sampling, and may occasionally be technically incorrect. SCNX makes no legal guarantees regarding the absolute accuracy, completeness, or financial applicability of these tracking metrics.
5.3. Customer Reviews and Feedback
SCNX may offer features that allow end-users to leave public ratings, written reviews, or feedback on your Shared Content to help other users make informed decisions. All reviews are subject to SCNX's moderation policies to prevent harassment or spam. However, SCNX reserves the absolute right to moderate, leave visible, or remove reviews at our sole editorial discretion. As a Submitting Owner, you have no legal right or entitlement to demand the removal, alteration, or censorship of legitimate reviews or ratings left by users, regardless of whether you feel their negative sentiment is justified.
5.4. Off-Platform Monetization and Tax Liability
Currently, SCNX does not provide an integrated, on-platform payment gateway for creators to sell Shared Content natively. However, you are permitted to monetize your creations externally (e.g., selling private import keys via external storefronts like Patreon, Ko-fi, or your own dedicated website), provided the content itself complies entirely with these Terms.
- B2B vs. B2C Clarification: By utilizing the Marketplace to monetize your Shared Content (even if the transaction occurs off-platform), you acknowledge that you may be legally acting as a commercial entity (Unternehmer) rather than a private consumer (Verbraucher) under German law. You are solely responsible for fulfilling all corresponding legal obligations associated with running a digital business.
- Complete Liability: SCNX takes absolutely no responsibility for off-platform transactions, disputes, chargebacks, or refunds. You are solely and entirely responsible for compliance with all applicable consumer protection laws (including the provision of withdrawal rights / Widerrufsrecht), tax obligations (including the correct calculation and remittance of VAT/sales tax globally), and financial regulations related to your external sales.
5.5. Future On-Platform Monetization System
SCNX reserves the right to introduce an official, native monetization system for the Marketplace in the future to facilitate direct sales. Should this occur, these Terms will be updated to reflect specific fee structures, platform commission rates, payout schedules, and exclusivity rules.
- Continued Use of External Providers: Even after the official launch of a native SCNX monetization system, you may continue to utilize external third-party payment providers or storefronts for your existing and future Shared Content.
- Price Parity Requirement: If you choose to utilize external payment providers alongside the official SCNX monetization system, you are strictly required to maintain Price Parity. This means the final price presented to the end-user (inclusive of all applicable taxes, service fees, and surcharges) on any external site or third-party platform must be identical to the final price listed for that same content on the SCNX Marketplace. You are explicitly prohibited from offering lower prices, exclusive discounts, or "external-only" deals that undercut the SCNX Marketplace pricing.
- Grace Period: Upon the official launch of a native monetization system, any existing off-platform monetization methods for SCNX Shared Content must be migrated to the official system or made compliant with the newly updated Terms (specifically regarding Price Parity) within a strict grace period of one (1) calendar month. Failure to comply or adapt within this timeframe will result in the immediate revocation of your SHARED_CONTENT privileges.
6. Liability and Warranties (Haftung)
Our liability regarding the operation, availability, and security of the Marketplace is determined strictly by the laws of the Federal Republic of Germany:
- Unlimited Liability: ScootKit UG (haftungsbeschränkt) is fully liable for damages resulting from injury to life, body, or health, as well as for damages caused by intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit) by us, our legal representatives, or our authorized vicarious agents.
- Material Breaches (Slight Negligence): In cases of slight negligence (leichte Fahrlässigkeit), we are liable only for the breach of essential contractual obligations (Kardinalpflichten)—meaning those fundamental obligations whose fulfillment is strictly necessary for the proper execution of the contract and on which you regularly rely. In such instances, our liability is strictly limited to foreseeable, typical contractual damages.
- Exclusions: Any further liability for damages—including liability for lost profits, lost data, loss of business opportunity, or indirect consequential damages—is expressly excluded. We specifically do not warrant that the Marketplace API will be uninterrupted, flawlessly secure, or completely error-free at all times.
- Indemnification: You agree to fully indemnify, defend, and hold harmless ScootKit UG (haftungsbeschränkt) against any and all claims, damages, financial penalties, or legal fees arising from third parties due to your Shared Content violating intellectual property rights, breaching Discord API rules, violating data protection laws (including the GDPR), or contravening any provision of these Terms.
- Disclaimer of Endorsement and Quality: The publication, surfacing, or promotion of Shared Content on the Marketplace does not constitute an endorsement, guarantee, or official warranty by SCNX regarding its safety, coding quality, functionality, or fitness for any particular purpose.
- "As-Is" Provision for Importers: You acknowledge that all Shared Content created by the community is provided to importing end-users entirely "as-is" and at their own risk. SCNX cannot act as an insurer for the perfection of community-generated code.
7. Enforcement, Moderation, and Termination
We enforce these terms strictly to protect the operational integrity of the SCNX platform and to maintain our critical standing with third-party infrastructure providers like Discord.
7.1. Automated Scanning and Moderation
SCNX employs advanced automated systems to continuously scan submitted Shared Content for policy violations, malicious code snippets, embedded Personal Information (PII), and platform compatibility issues. By submitting content, you consent explicitly to this automated scanning process. Content flagged by these automated systems may be instantly hidden, rejected, or permanently deleted without requiring human review or prior notification.
7.2. Notice of Violation and Required Adjustments
In many cases, if we determine that your Shared Content violates these Terms or our quality guidelines, we will notify you via the SCNX dashboard or the email address associated with your account. This notice will specify the offending content and the necessary changes required to bring it into compliance.
You will generally be provided a specific timeframe (typically 7 to 14 days, as explicitly stated in the notice) to adjust, update, or remove the problematic content. If you fail to make the required adjustments within this timeframe, SCNX reserves the right to forcefully remove the content, unlist it from the Marketplace, or impose further restrictions on your account privileges.
Exception for Immediate Removal: Please note that this opportunity to adjust content is a courtesy and not a guaranteed right. In cases involving severe violations—such as the inclusion of malicious code, Personal Information (PII), scraped Discord API data, illegal content, or severe spam—SCNX reserves the absolute right to remove the content immediately and permanently without any prior warning or grace period.
7.3. Retroactive Removal from End-User Bots
To fully protect the SCNX ecosystem, our moderation capabilities extend beyond simply unlisting items from the Marketplace storefront. If SCNX determines that a piece of published Shared Content poses a severe security risk, violates Discord's Terms of Service, contains prohibited Personal Information (PII), or otherwise fundamentally breaches these Terms, we reserve the absolute right to retroactively delete, disable, or forcefully remove that specific configuration directly from the active bots and servers of any end-users who have already imported it. We execute this protective measure entirely at our own discretion to halt the spread of malicious, broken, or non-compliant code and ensure the safety of the wider platform.
7.4. Immediate Termination of Access
Any severe violation of these Terms—specifically including, but not limited to, the offenses of submitting scraped Discord API data (Section 3.1) or the inclusion of Personal Information (Section 3.2)—will result in the immediate termination of your organization's access to the Marketplace Services, without any prior warning or grace period as outlined above.
7.5. Forfeiture of Personal Accounts
In the event of a severe, malicious, or highly negligent violation (such as distributing harmful Custom Commands designed to crash bots, or engaging in severe data scraping), SCNX reserves the right to escalate penalties beyond an organization-level ban. We may immediately terminate the personal SCNX and Dashboard accounts of the specific individuals who uploaded, authored, or facilitated the violating content.
7.6. Evasion of Bans
If your account or organization is terminated due to policy violations, you are strictly prohibited from creating a new account, using alternate Discord accounts, or leveraging existing active accounts to bypass the restriction. Attempting to evade a ban demonstrates malicious intent and will result in permanent blacklisting of your IP address, associated payment methods, and connected Discord networks from all SCNX services.
7.7. Dormant Accounts and Orphaned Content
- Dormant Accounts: To maintain a clean and active ecosystem, if your SCNX account becomes entirely inactive (no logins or updates) for a period of twelve (12) consecutive months, SCNX reserves the right to prune our database by archiving, unlisting, or permanently deleting your published Shared Content.
- Orphaned Content: If your marketplace organization or personal account is deleted or terminated (either voluntarily or due to rule violations), SCNX retains the absolute right to keep your previously published Shared Content live on our servers. This is critically necessary to prevent breaking the active configurations and live bots of thousands of end-users who have already imported the content, and this action is legally executed under the perpetual license granted in Section 4.1.
7.8. Contractual Penalty for Entrepreneurs (Vertragsstrafe)
To protect the vital infrastructure of the SCNX platform, our user base, and our standing with third-party providers like Discord, strict enforcement of these core rules is necessary. Provided that you act as an entrepreneur (Unternehmer within the meaning of Section 14 BGB) when using the Marketplace, you hereby commit to paying an appropriate contractual penalty (Vertragsstrafe) for each case of a culpable, severe violation of these Terms.
Severe violations that trigger this contractual penalty explicitly include, but are not limited to:
- Any breach of the Marketplace API Usage Restrictions (Section 3.8), including unauthorized data scraping, intentional payload manipulation, or competitor extraction.
- Any violation of Discord's Terms of Service or Developer Policies, specifically including the submission or distribution of scraped Discord API data (Section 3.1).
- The inclusion, solicitation, or unauthorized storage of Personal Information or PII (Section 3.2).
- The distribution of Custom Commands containing malicious logic, harmful external API calls, or unauthorized data transmission (Section 3.4).
- Uploading or sharing illegal content or infringing upon third-party intellectual property rights (Section 3.6).
The exact monetary amount of this contractual penalty shall be determined by ScootKit UG (haftungsbeschränkt) at its reasonable commercial discretion (nach billigem Ermessen). In the event of a dispute regarding the appropriateness of the penalty amount, it shall be subject to review by the competent court ("Hamburger Brauch"). This penalty applies independently of, and is without prejudice to, any further claims for damages, account termination, or injunctive relief SCNX may pursue.
8. Privacy and Data Protection
8.1. Privacy Policy Integration
The collection, storage, and processing of your personal data as a Submitting Owner—including your IP addresses, Discord IDs, payment information, and email address—are governed strictly by our primary, overarching SCNX Privacy Policy.
8.2. Data Controller Status
SCNX acts as the Data Controller solely for the platform's underlying infrastructure and the delivery mechanisms of the Marketplace. However, if your Shared Content (such as a complex Custom Command) is designed to legally process the personal data of end-users within a specific Discord server, you act as an independent Data Controller for that specific processing activity. You are solely and entirely responsible for ensuring complete compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws regarding the data your content processes, including handling user deletion requests (Article 17 GDPR) independently.
9. Reporting, DSA Compliance, and Appeals
9.1. Reporting Violations
If you discover Shared Content on the Marketplace that infringes upon your copyright, contains Personal Information, utilizes scraped data, or otherwise violates these Terms, you must report it immediately so we can take swift action. Please send a detailed email to [email protected] including the exact import key/URL of the content, a clear explanation of the violation, and any relevant proof (such as screenshots or original source code links).
9.2. Designated Point of Contact (DSA Compliance)
In accordance with the Digital Services Act (Regulation (EU) 2022/2065), our officially designated single point of contact for member state authorities, the European Commission, and users of the service is [email protected]. Official communications and legal inquiries may be conducted in German or English.
9.3. Moderation Appeals and EU DSA Exemption
We strive for ultimate fairness in both our automated and manual moderation processes. As a micro-enterprise, ScootKit UG (haftungsbeschränkt) is legally exempt from the formal obligation to provide an internal complaint-handling system ( Art. 20 Regulation (EU) 2022/2065) or to participate in certified out-of-court dispute settlement bodies (Art. 21 Regulation (EU) 2022/2065). However, if you strongly believe a moderation decision regarding your Shared Content or account was made in error, please submit a polite, detailed appeal directly to us at [email protected] so our support team can manually review the matter.
10. General Provisions
- Governing Law: All legal relationships, disputes, and claims between you and ScootKit UG (haftungsbeschränkt) arising from or in connection with these Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG).
- Jurisdiction: To the extent legally permissible under German law, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms shall be the competent courts of Munich, Germany.
- Modifications and Retroactive Application: SCNX reserves the right to update, modify, or completely replace these Terms at any time to adapt to new legal realities or platform features. We will notify you of significant changes via an announcement on the SCNX dashboard or via email. Unless explicitly stated otherwise in the update notice, modifications to these Terms apply retroactively to all previously submitted Shared Content to ensure uniform legal compliance across the entire database. Continued use of the SHARED_CONTENT features after such changes constitutes your binding acceptance of the new Terms, and you are responsible for ensuring your older content complies with the updated requirements.
- Severability (Salvatorische Klausel): Should individual provisions of these Terms be or become legally invalid, void, or unenforceable, the validity of the remaining provisions shall remain completely unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose legal and economic effects come closest to the original objective intended by the contracting parties.
- Feedback and Suggestions: We welcome ideas to improve the platform. However, any feedback, comments, bug reports, or suggestions you may provide regarding the Marketplace is entirely voluntary. We will be absolutely free to use such feedback, comments, or suggestions to improve SCNX as we see fit, without any obligation, restriction, or financial compensation owed to you.
